Universal Machine Company warrants that its product will be free of defects in materials and workmanship under normal single shift use and service for ninety (90) days on coin sorters, portable coin counters and currency counters; thirteen (13) months from date of shipment or twelve (12) months from date of receipt of goods, whichever is earlier on high speed coin counters and coin baggers [seven (7) months from date of shipment or six (6) months from date of receipt of goods, whichever is earlier, for multiple shift operation].
Universal’s sole obligation under this warranty shall be limited to repairing and/or replacing any product due to faulty materials or poor workmanship. Repaired or replaced parts shall assume the identity of the original for purposes of this warranty and this warranty shall not be extended with respect to such parts except under special circumstances and with the written consent of Universal.
Buyer must report any warranted defect to Universal in writing within ten (10) days of discovery, permit the Universal or its agents to inspect the defective part, and if requested by Universal ship the defective part, at Buyer’s expense, to Universal. This warranty does not apply to normal wear items and small expendable items such as rubber parts, belts, electrical parts, etc., which are recognized as requiring replacement from time to time on a regular basis. Parts replaced under warranty will be shipped on C.I.P. basis. Local clearance, customs duties, taxes, local transportation and other costs will be for the account of buyer.
IN NO EVENT SHALL UNIVERSAL MACHINE COMPANY NOR ITS AFFILIATED COMPANIES, OFFICERS, DIRECTORS, AGENTS, OR EMPLOYEES BE LIABLE FOR RESULTANT OR SPECIAL DAMAGES. THIS WARRANTY IS EXPRESSED IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, WHETHER FOR MERCHANTABILITY OR FITNESS FOR A PATRICULAR PURPOSE OR OTHERWISE. THIS WARRANTY SHALL NOT APPLY TO ANY PRODUCT WHICH HAS BEEN SUBJECT TO MISUSE, NEGLECT, ACCIDENT OR OTHER CAUSE BEYOND UNIVERSAL’S CONTROL, NOR SHALL IT APPLY TO ANY PRODUCT WHICH HAS BEEN REPAIRED OR ALTERED BY ANY PERSON NOT AUTHORIZED BY UNIVERSAL MACHINE COMPANY.
